THE Noble Emperor team of Barry Geraghty, Tony Martin and JP McManus were cleared of all wrongdoing at Turf Club headquarters on Monday night.

Geraghty had been banned for 30 days, Noble Emperor for 60 days and Martin fined €3,000 by the stewards on the day after the rider was found to be in breach of Rule 212 (failing to take all reasonable and permissible measures to give his mount the full opportunity to win or obtain his best possible place) in a 2m handicap hurdle at Limerick on April 3.

However, the three-man panel consisting of Judge Tony Hunt, Lesley Crawford and Martin O’Donnell ruled in Geraghty’s favour at the four-hour appeal, which will allow Geraghty to ride at the forthcoming Punchestown Festival that starts next Tuesday, April 26.

“In our view, there was no opportunity for Noble Emperor to win the race at any relevant time,” Judge Tony Hunt told the floor in his verdict.

“This race must be looked at as an individual race. It turned out to be an unsatisfactory race with enterprising tactics used by the winning jockey. In our view, the opportunity to finish first was gone very early in the race. Second was the best possible position he could achieved given the way the race panned out.”

Delight for Geraghty

Geraghty, who had stayed silent in the lead up to the appeal, was understandably thrilled with the outcome and admitted he was utterly shocked when the ban was handed out by the stewards on the day.

“It has been a long night,” said the relieved rider. “I am delighted with the decision. It was a tricky race for me to ride. I am just glad it was seen in its true light.

“I was flattened on the day when I heard of the suspension. It is the most shocked I have been in racing away from hearing news of injuries.”

He added: “I believed at every stage during the race that I was doing the right thing. If I was in a similar situation again, I would probably do what I did. That is what I believed was the right thing to do. I am glad that the appeals committee could relate to what I was trying to do.”
