Fox wins appeal after ban for weighing in light

JOCKEY Kieren Fox won his appeal against a ban imposed for weighing in light on Thursday as trainer Lee Carter was blamed for the offence.

Fox’s two-day suspension was lifted and the fine Carter received after the incident at Lingfield last month was doubled to £1,000.

It was the second time Fox has successfully appealed to the BHA’s disciplinary panel, having overturned a suspension for the same offence in 2011.

Fox had finished second on the Carter-trained State Of The Union in a 6f handicap only to weigh in 3lb light when he returned without the weight cloth.

CCTV footage played to the inquiry showed the jockey weighing out and handing his tack to Carter with the weight cloth clearly visible, but it could not be found after the race despite Fox retracing his steps  to the unsaddling area with a stipendiary steward. There was also no evidence of the weight cloth being lost during the race.

As a result the panel found Fox, who was represented by Rory Mac Neice, not in breach of the rules, allowed his appeal and quashed the two-day suspension.

Carter was found in breach after his representative Dawn Bacchus, of the National Trainers Federation, said the trainer could offer no further information on the missing weight cloth. He accepted this had been with the saddle when it was given to him by Fox immediately after weighing out.

Fox did not attend the hearing and rode at Lingfield, but he said later: “I have got my days back and can carry on riding. 

“I was never guilty of losing the weight cloth so shouldn’t have been banned in the first place. Both times this has happened it has not been my fault.”

Under rules amended in 2013 when jockeys weigh in light, both rider and trainer receive a joint penalty if the stewards are unable to establish the cause of the weight deficit.

After Thursday’s hearing, BHA spokesman Robin Mounsey said: “We are constantly assessing our rules and policies to ensure they are the most appropriate and hold meetings periodically to discuss them. It is feasible this rule could be revisited during one of those discussions in the future.”
