N.Y. attorney general probes NFL floor pricing

ALBANY — Attorney General Eric Schneiderman threw a yellow flag at the NFL and Yankees for placing minimum “floor” prices on tickets that fans want to re-sell.

Schneiderman and several other states attorneys general are investigating the NFL and its teams that encourage, and sometimes require, ticket holders to use Ticketmaster’s “NFL Ticket Exchange” platform to re-sell tickets they want to dump.

The probe is into whether such actions violate anti-trust laws.

The NFL Ticket Exchange prohibits a seller from setting a price below a certain level, often the face value of the ticket, Schneiderman said in a report released Thursday.

Such floors deprive buyers from purchasing tickets at below face-value, even for teams going nowhere, the report says.

“It is therefore easy for buyers to be fooled into believing what they are paying is the market price for a ticket,” Schneiderman’s report says.

The report says the Yankees also set floor prices for the re-sale of tickets.

But Schneiderman’s office would not say whether the team is also under investigation.

“Overall, (Schneiderman) believes there is little to say in favor of price floors,” the report says.

A spokeswoman for the Yankees had no immediate comment.

An NFL spokesman did not return calls for comment.

The floor pricing issue was part of a larger report Schneiderman released Thursday following a multi-year investigation into the ticket industry.

The Daily News reported Wednesday on its website that the probe found that 54% of all tickets to hot concerts are set aside for industry insiders or pre-sale customers before they are offered to the general public.

And brokers looking to offer tickets way above face value often illegally deploy “bot” software that allow them to buy thousands of tickets within seconds of them going on sale.

Schneiderman wants to reinstitute “reasonable” caps on how much tickets can be re-sold for.
