Motion filed to strike Peyton Manning allegation from suit

The University of Tennessee continues to do its best to protect Peyton Manning.

The University of Tennessee does not want the Peyton Manning allegation to be part of a sexual assault lawsuit they face, which alleges a history of sexual violence on campus enabled by the school.

On Tuesday, the university filed a motion in federal court to strike a paragraph referencing the alleged Manning assault from the suit.

Bill Ramsey, the lawyer representing Tennessee, said in his motion the paragraph should be removed “because of the utter lack of relevance the decades-old allegation against Peyton Manning has to this lawsuit.”

In an earlier statement, Ramsey said the university “acted lawfully and in good faith” in the situations outlined in the plaintiffs’ complaint.

The motion also states that the reference to Manning is “immaterial, impertinent and scandalous,” and was “misguided (and unfortunately successful) attempt to generate publicity for this meritless lawsuit.”

The university also says they never received an explanation why the Manning allegation was included.

Five of the six women filing the suit against the university claim they were raped while one claims she faced harrassment for supporting another victim.

Manning’s accuser, Jamie Naughright, is not one of the plaintiffs.

The motion does mention an attorneys’ statement to the media saying the Manning allegation serves as a “backdrop to the institutional issues.”
