Justin Brown, 19, claims in a new suit that J.R. Smith attacked him outside Artichoke Basille’s Pizza in Chelsea last November after refusing a request to pose for a photo.

Former Knicks star J.R. Smith will have to play defense against a lawsuit filed by the New Jersey man who accused the NBA bad boy of choking him at a Manhattan pizzeria.

Justin Brown, 19, claims in a new suit that Smith attacked him outside Artichoke Basille’s Pizza in Chelsea last November after refusing a request to pose for a photo.

Smith first verbally dressed down Brown and his friend. Then he charged at him from across the street and “grabbed and struck (him) in his neck and head,” the suit says.

“(Smith’s) attack was without any physical provocation,” says the suit filed Thursday in Manhattan Supreme Court.

Manhattan prosecutors refused to bring charges against Smith, saying the evidence didn’t support criminal prosecution.

“If they have the audacity to file a frivolous claim against J.R., we will counterclaim for defamation and defend the suit aggressively,” said Smith’s lawyer, Alex Spiro.

Brown’s lawyer said Smith committed a flagrant foul.

“This case arises out of an inexplicable violent attack by a professional athlete against a teenager fan,” said attorney Leon Jacobson.

“There is no question that Mr. Smith violated the law when he attacked Justin without any justification. To date, instead of an apology, we have witnessed sorry denial and disingenuous victory-clasps.”

The fiery Cleveland Cavaliers guard was captured on a cell phone video walking away from Brown and his buddies after apparently rebuffing their photo request.

“That’s why New York kicked you out, yo!” Brown remarked, according to sources.

Brown told police that’s when Smith, who is 6-feet-6 and 225 pounds, checked the teen against the building and put his hands around the high school student’s neck.

But sources said footage of the incident showed Brown saying he would “start with J.R. Smith and sue him” and that the altercation was no more than a shove.

Brown filed a separate suit in February against the pizzeria.
