Hoops star JR Smith will not be charged in connection with a 19-year-old’s claim that he was choked by the former Knicks guard outside a Chelsea pizzeria, the Daily News has learned.

“After a thorough investigation of the circumstances surrounding this case, we have concluded that the evidence does not support criminal charges against Mr. Smith,” Manhattan DA spokesman Patrick Muncie said.

Smith’s attorney Alex Spiro praised the decision, adding that the DA and NYPD have “cleared (Smith) of all wrongdoing.”

“We are thankful there was not a rush to judgment and the truth came out,” Spiro said.

JR Smith will not be charged in connection with a 19-year-old’s claim that he was choked by the former Knicks guard outside a Chelsea pizzeria in November.

The teen, Justin Brown, said Smith attacked him outside Artichoke Basille’s Pizza on W. 17th St. about 4 a.m. on Nov. 13, near celebrity hotspot 1OAK.

Smith, who is now on the Cleveland Cavaliers, was in the city to face his former team the same day.

Sources said that footage of the incident revealed that Brown said he would “start with JR Smith and sue him” and that the physical altercation was no more than a shove.

Police determined Smith’s offense amounted to a violation — harassment — and not a crime, so they prepared a report indicating such and closed it out.

Brown’s lawyer, Leon Jacobson, blasted prosecutors and cops, saying the decision not to charge was “thinly veiled government favoritism of a celebrity.”

“This is another example of a system that always favors the rich and well-connected. I don’t know how else to explain their decision to a 19-year-old from Harlem,” he said.

“Justin did not deserve to be attacked, he was hurt and humiliated, but the government’s refusal to stand up for him is an even harder pill to swallow.”
